COVID-19

On March 13, 2020, the Côte Saint-Luc election office received a directive from the Quebec Ministry of Municipal Affairs and Habitation stating that all by-elections across Quebec planned until April 26, including the one in Côte Saint-Luc, would be postponed due to the COVID-19 pandemic.

A new by-election date will be set by the Ministry.

A Notice of Registration will be mailed to all addresses in District 8 of Cote Saint-Luc specifying the addresses associated with the voting locations for Election Day and for the Advance Poll.

If your NAME does not appear on this card, you must make an application to the Board of Revisors in order to be entered on the list of electors.

Only those entered on the list of electors may vote during this election.

Revision period

To be eligible to vote, an individual must be a “Qualified Elector” as at February 19, 2020.

It is the elector’s responsibility to ensure that their name appears on the Municipal List of Electors and his/her details are correct.

To do so, a Revision Period will be held on the following dates and times, where Côte Saint-Luc residents who are qualified electors may visit, in person, to apply for entry onto the list of electors:

  • Monday, March 23, 2020, from 2:30 pm to 10 pm

The Board of Revisors will sit at:

NOTE: There will be a revision of the Municipal Electoral List only if there is a contested election for the position in question.

To be considered a “Qualified Elector” entitled to vote, an individual must be a Canadian Citizen and:

a. Be aged 18 years or older as of April 5, 2020;

AND as of February 19, 2020, either (b) or (c)

b. Reside in the City of Côte Saint-Luc, and in Quebec for at least 6 months; OR
c. Have been, for at least 12 months, the owner of an immovable or the occupant of a business establishment in the municipality.

For candidates – Nomination and pre-authorization

A. Candidate authorization

A potential candidate must seek authorization from the Director General of Elections for Quebec to start fundraising and to open a bank account.

Kindly contact the Returning Officer, Me Jason Prévost or his assistant for more details and to obtain the prescribed forms (DGE-1028 and DGE-1028.1) which require signatures of electors supporting your request for authorization. These must be completed and submitted either prior to or along with the completed nomination form.

B. Nomination

The nomination period, by-appointment only, is from Friday, February 21, 2020 to Friday, March 6, 2020 as follows:

Required Documents

Bring your driver’s license, medicare card, duly completed authorization request (including signatures) as well as the duly completed nomination papers containing at least the following number of signatures of electors from the municipality:

  • For Councilor: At least 25 signatures.

It is STRONGLY advised to collect more signatures than are needed as each signature must be verified against the List of Electors.

All electors supporting a candidate’s nomination must be on the list of electors at the beginning of the election period. The information contained in the entry on the nomination form must match their entry on the list of electors. This information must be correct, complete, and legible for their entry to be counted. It is therefore possible than some signatures will be refused for the purposes of a nomination which, could lead to the inability for the Returning Officer to accept the nomination paper should the required number of valid signatures after verification not be met.

**FOR MUNICIPAL EMPLOYEES:
Under the law, municipal employees are prohibited from engaging in “partisan work” on penalty of a significant fine.  However, in addition to being permitted to work as an Election Officer, municipal employees who are also qualified Electors for this By-election may sign a particular Candidate’s nomination and/or pre-authorization papers, and/or may contribute a political donation to a particular Candidate (up to the legal limit). Also, any municipal employee regardless of where he/she resides, may attend political meetings. All of these 3 latter activities are not considered “partisan work” under the law and are therefore legally permitted.

A QUALIFIED ELECTOR IS:

a person who is of legal age on April 5, 2020 and:

  • is a Canadian citizen;
  • is not under curatorship;
  • has not been convicted of an offence that is a corrupt electoral practice;

and meets one of the following conditions:

  • be domiciled in the territory of the municipality on February 19, 2020 and since at least August 19, 2019 in Quebec.

 or

  • since at least February 19, 2019, be either:
    • the sole owner of an immovable in the territory of the municipality, provided that he is not domiciled in the territory of the municipality and have submitted a written application for entry on the municipal list of electors with the Board of Revisors, or
    • the sole occupant of a business establishment in the territory of the municipality provided that he is not the owner of an immovable elsewhere in the territory of the municipality, is not domiciled in the territory of the municipality and have submitted a written application for entry on the municipal list of electors with the Board of Revisors. NOTE: the sole owner of several immovables or the sole occupant of several business establishments must register at the address of the immovable or the business establishment which has the greatest property or rental value.

or

  • the undivided co-owner of an immovable or co-occupant of a business establishment in the territory of the municipality provided that he has been designated by means of a power of attorney signed by the majority of co-owners or co-occupants who are electors of the municipality, transmitted to the Board of Revisors prior to March 24 2020.
