Draft By-law n° 2630 concerning Specific Construction, Alteration or Occupancy Proposals for an Immovable (SCAOPI)

On September 9, 2024, the Côte Saint-Luc City Council adopted the Draft By-law n° 2630 concerning Specific Construction, Alteration or Occupancy Proposals for an Immovable (SCAOPI).

Goal

The purpose of this by-law is to enable the Council, after receiving the opinion of the Planning Advisory Committee (PAC), to authorize a request for a Specific Construction, Alteration or Occupancy Proposal (SCAOPI) even though it contravenes any of the municipality’s planning by-laws, and to make such authorization subject to the conditions it determines. Furthermore, each proposal submitted to this procedure may be subject to referendum approval by eligible citizens residing in the same zone or in those contiguous to the proposal.

  • The By-law enables the municipal council, after receiving the opinion of the Planning Advisory Committee (PAC), to authorize such a proposal based on criteria set out in the By-law, and to prescribe any conditions that the applicant must follow.
  • The By-law outlines the modalities for processing an application, such as the contents that must be included in the application, as well as the different steps it must follow.

    • It encourages public transport and walking, while reducing traffic issues.
    • During construction, it will manage noise, dust, and other disturbances.
    • It plans to handle waste properly and keep public spaces clear.

By-Law Adoption Approval Process

For the proposed By-law to come into effect, it must follow the different steps of the adoption and approval process prescribed by provincial laws, which are outlined below:

Pending the Council’s resolution to adopt the By-law (final), the proposed By-law n° 2630 will come into effect upon reception of a compliance certificate from the Montreal Agglomeration. It should be noted that the proposed By-law must go through a public consultation process as per Section 123 of the Act Respecting Land Use Planning and Development. The By-law itself may not be subject to approval by way of referendum, however, once the By-law is in effect, every individual proposal submitted to this procedure may be subject to referendum approval by eligible citizens residing in the same zone or in those contiguous to the proposal.
