{"id":44847,"date":"2023-05-17T14:43:46","date_gmt":"2023-05-17T18:43:46","guid":{"rendered":"https:\/\/cotesaintluc.org\/damage-to-private-property\/"},"modified":"2023-11-07T11:39:30","modified_gmt":"2023-11-07T16:39:30","slug":"damage-to-private-property","status":"publish","type":"page","link":"https:\/\/cotesaintluc.org\/en\/the-city\/contact-us\/report\/damage-to-private-property\/","title":{"rendered":"Damage to private property"},"content":{"rendered":"<div class=\"gb-container gb-container-9e7fc006\"><\/div>\n<h2 class=\"wp-block-heading\">Damage to private property that is <strong>outside<\/strong> the City right-of-way or close to the sidewalk<\/h2>\n\n<p>Please note that the City of C\u00f4te Saint-Luc must receive a written notice within 15 days following the incident for any material damages, failing which the City of C\u00f4te Saint-Luc will not be liable for any damages, as per section <a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/en\/document\/cs\/c-19\">585 of the Cities and Towns Act<\/a> .<\/p>\n\n<p>In the event that you feel the City has damaged your private property, please:<\/p>\n\n<ul>\n<li>note the date and time you noticed it;<\/li>\n\n\n\n<li>photograph the damage (if possible).<\/li>\n<\/ul>\n\n<p>Send an email or a letter explaining the incident with all evidence to <a href=\"mailto:claims@cotesaintluc.org\">claims@cotesaintluc.org<\/a> or to City Clerk, City Hall, 5801 Cavendish Blvd., C\u00f4te Saint-Luc, Quebec, H4W 3C3.<\/p>\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity is-style-wide\"\/>\n\n<h2 class=\"wp-block-heading\">Damage to private property <strong>within<\/strong> the City right-of-way or close to the sidewalk<\/h2>\n\n<p>The City reserves its rights to refuse any claim for damages to private property located within the City right-of-way or close to the City sidewalk based on the following provisions of the <a href=\"https:\/\/cotesaintluc.org\/wp-content\/uploads\/2023\/11\/BY-LAW_2217_Zoning.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">City\u2019s zoning by-law 2217<\/a>:<\/p>\n\n<div style=\"height:45px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\">Damage to basketball hoops located within the City right-of-way:<\/h3>\n\n<p>The presence of any construction in the City right-of-way, including basketball hoops, is prohibited (By-law 2217, <a href=\"https:\/\/cotesaintluc.org\/wp-content\/uploads\/2023\/11\/BY-LAW_2217_Zoning.pdf#page=36\" target=\"_blank\" rel=\"noreferrer noopener\">section 4-5<\/a>). As such, no compensation can be offered for any damages resulting from City operations.<\/p>\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/cotesaintluc.org\/wp-content\/uploads\/2023\/11\/Basketball_CityRight-of-way_IllustrationAerial_EN.png\" alt=\"\" class=\"wp-image-937\"\/><\/figure>\n\n<div style=\"height:45px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\">Damage to retaining walls, driveway curbs and private walkway borders located within 2 ft. of the City sidewalk:<\/h3>\n\n<p>No retaining walls, driveway curbs or private walkway borders shall be located within 2 ft. (0.60 m) of the City sidewalk (By-law 2217, sections <a href=\"https:\/\/cotesaintluc.org\/wp-content\/uploads\/2023\/11\/BY-LAW_2217_Zoning.pdf#page=36\" target=\"_blank\" rel=\"noreferrer noopener\">4-5<\/a> and <a href=\"https:\/\/cotesaintluc.org\/wp-content\/uploads\/2023\/11\/BY-LAW_2217_Zoning.pdf#page=49\" target=\"_blank\" rel=\"noreferrer noopener\">7-2-3h<\/a>).<\/p>\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/cotesaintluc.org\/wp-content\/uploads\/2023\/11\/ReportDamage_RetainingWall.png\" alt=\"\" class=\"wp-image-935\"\/><\/figure>\n\n<div style=\"height:45px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\">Damage to shrubs and hedges located within 3 ft. 3 in of the City sidewalk:<\/h3>\n\n<p>It is not permitted to plant hedges or shrubs within 3 ft. 3 in.
