Damage to private property that is outside the City right-of-way or close to the sidewalk
Please note that the City of Côte Saint-Luc must receive a written notice within 15 days following the incident for any material damages, failing which the City of Côte Saint-Luc will not be liable for any damages, as per section 585 of the Cities and Towns Act .
In the event that you feel the City has damaged your private property, please:
- note the date and time you noticed it;
- photograph the damage (if possible).

Damage to private property within the City right-of-way or close to the sidewalk
The City reserves its rights to refuse any claim for damages to private property located within the City right-of-way or close to the City sidewalk based on the following provisions of the City’s zoning by-law 2217:
Damage to basketball hoops located within the City right-of-way:
The presence of any construction in the City right-of-way, including basketball hoops, is prohibited (By-law 2217, section 4-5). As such, no compensation can be offered for any damages resulting from City operations.
Damage to retaining walls, driveway curbs and private walkway borders located within 2 ft. of the City sidewalk:
No retaining walls, driveway curbs or private walkway borders shall be located within 2 ft. (0.60 m) of the City sidewalk (By-law 2217, sections 4-5 and 7-2-3h).
Damage to shrubs and hedges located within 3 ft. 3 in of the City sidewalk:
It is not permitted to plant hedges or shrubs within 3 ft. 3 in. (0.99 m) of City property or a City sidewalk (By-law 2217, section 11-8-1).
Furthermore, all shrubs and hedges must be adequately protected during the winter.
Shrubs are considered to adequately protected if they are fully covered by a solid material or tied up very tightly.
Hedges must be protected by metal and wood stakes and covered by a burlap or geotextile.
Claims

You can also consult the City’s Zoning By-law 2217 at City Hall, located at 5801, Cavendish boulevard, during normal working day hours, said hours being from Monday to Friday between 8:30 am and 4:30 pm.
