Draft By-law no. 2217-63 to amend the Zoning By-Law to authorize additional uses in zone CD-9

On January 15, 2024, the Côte Saint-Luc City Council adopted the draft by-law no. 2217-63 to amend the Zoning By-Law to authorize additional uses in zone CD-9, more specifically for the building located at 5755-5757 Cavendish Boulevard.

It should be noted that this property/zone was recently subject to a prior zoning amendment (2217-61, in force 2023-08-23), which also had the effect of authorizing additional uses in this zone. Following this previous amendment, the Urban Planning department was recently approached again by the owner of this property to discuss the possibility of authorizing additional uses that are currently not permitted in this zone.

Goal

This amendment is to authorize the following uses, which are not currently permitted in this zone:

  • The use “Childcare services” from the group “Retail commerce – 1”.
  • Ice cream parlours & milk bars (Restaurant – 2).
  • Small interior recreation facilities such as gymnasiums & games rooms (Recreational without incidence – 2).
  • Only the uses “Recording studios, musicians’ studios, sewing workshops, private schools such as music or dance schools” from the group of uses “Retail commerce – 4”.

By-Law Adoption & Approval Process

For the present by-law to come into effect, its adoption & approval process must follow the different steps prescribed by provincial laws, which are outlined below:

Pending the Council’s adoption of the By-law (final draft), the above-mentioned adjustments will be integrated into the Zoning By-law no. 2217. It should be noted that the proposed amendment must go through a public consultation process as per Section 123 of the Act Respecting Land Use Planning and Development (RLRQ, c. A-19.1), and contains provisions that may be subject to approval by referendum of eligible voters.
